Warranty Return Policy
We fundamentally believe you will be thrilled with the products you purchase from the MiningTEK LLC Site/Store. That's because we go out of our way to ensure that they're designed and built to be just what you need. We understand, however, that sometimes a component may be defective. In that unlikely event, we invite you to review the following terms related to returning product.

Pricing and Price Reductions/Corrections
MiningTEK LLC reserves the right to change prices for products displayed at/on the MiningTEK LLC Site/Store at any time, and to correct pricing errors that may inadvertently occur.
Prices shown are in U.S. dollars. If you are paying for your order with an international Visa, MasterCard, or American Express credit card, please note that the purchase price may fluctuate with exchange rates. In addition, your bank or credit card issuer may also charge you foreign conversion charges and fees, which may also increase the overall cost of your purchase. Please contact your bank or credit card issuer regarding these fees. MiningTEK LLC has no responsibility for bank or credit card fees or foreign conversion charges/fees, and will not be responsible for any of these related and non-related fees or charges.
Order Acceptance/Confirmation
MiningTEK LLC may, in its sole discretion, refuse or cancel any order and limit order quantity. MiningTEK LLC may also require additional qualifying information prior to accepting or processing any order. Once we receive your Online order, we'll provide you with an email order confirmation. Your receipt of an order confirmation, however, does not signify MiningTEK LLC's acceptance of your order, nor does it constitute confirmation of our offer to sell; we are simply confirming that your order was processed through the site. The MiningTEK LLC Site/Store reserves the right at any time after receiving your order to accept or decline your order for any reason. If MiningTEK LLC cancels an order after you have already been billed, MiningTEK LLC will refund the billed amount.
Shipping & Handling

Shipping & Handling page to learn about how and when you will receive the products you purchased from the MiningTEK LLC Site/Store. Since the actual delivery of your order can be impacted by many events beyond MiningTEK LLC's control once it leaves our facilities, MiningTEK LLC cannot be held liable for late deliveries, lost items or damages due to shipping company. We will, however, work with you to ensure a smooth delivery. Your order may be subject to a tax or import duty based on your country. Please check with your local government before ordering to understand these taxes or import duties that may enforced on your order. MiningTEK LLC is not responsible for any shipment taxes or import duties incurred after your purchase has shipped as these import costs are based upon the customers local government and outside of MiningTEK LLC's responsibility.
Consumers Only
The MiningTEK Site/Store sells and ships products to end-user customers only, and we reserve the right to refuse or cancel your order if we suspect you are purchasing products for resale.
All MiningTEK Mining Rigs (GPU Miners) come with a HiveOS operating system that can be customized by the customer upon receiving their mining device.
PLEASE READ THIS DOCUMENT CAREFULLY! IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS. THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT ORDER AND/OR KEEP YOUR PRODUCT.
"These Terms of Sale ("Agreement") apply to your purchase of products, software, and/or services and support (together, "Product") sold in the United States by MiningTEK which is owned and operated by MiningTEK LLC ("MiningTEK"). Throughout the site, the terms "MiningTEK", “we”, “us” and “our” refers to MiningTEK LLC. You agree to these terms by placing your order. ALL SALES ARE FINAL.
Products, Availability and Limitations
Given the popularity and/or supply constraints of some of our products, MiningTEK LLC may have to limit the number of products available for purchase. Trust us, we're building them as fast as we can. MiningTEK LLC reserves the right to change quantities available for purchase at any time, even after you have placed an order. Due to the nature of Crypto Currency and volatility of the market, all the profits in the product description are for reference only and may vary. Advertised Hashrates and listed product speeds will vary due to algorithm complexity and changes in mining difficulty. Due to the increased demand for graphics cards and limited supply, all orders including rush orders (orders required by customer before estimated ship date) may include second hand/lightly used graphics cards that have been extensively tested and are still covered under their manufacturer warranty. Any customers that do not agree with MiningTEK LLC's products and availability including but not limited to the use of second hand or previously used graphics cards should not place an order with MiningTEK LLC. MiningTEK LLC is not responsible for any loss of income due to delayed orders. Because of increased demand and product shortages, orders will likely experience delays with completing and shipping orders. These are all noted extensively throughout the site and on each products page as well as whether each product is in stock or on backorder. These are clearly visible to all customers prior to ordering and agreed upon prior to ordering.
Advertised mining speed/hashrates as well as advertised profits and earnings are estimated and actual results will vary. We suggest all customers research the Crypto Currency Market and advertised products before purchasing. All MiningTEK LLC miners require large power draw from your wall socket, please check the product pages for estimated power usage for each miner before purchasing as MiningTEK LLC is not responsible for the cost of electricity or misrepresenting any products/services by not factoring in electric costs for your miner and/or product purchased. The electricity costs incurred from mining with MiningTEK LLC products or affiliated products are your responsibility and posted estimated power usage for each product is displayed before your purchase. Additionally MiningTEK LLC and affiliate products sold are not responsible for any electrical issues, product loss, product damages, CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES. Furthermore, there may be occasions when MiningTEK LLC confirms your order but subsequently learns that it cannot supply the ordered product. In the event we cannot supply a product you ordered, MiningTEK LLC will contact the buyer and offer an equivalent product in exchange otherwise MiningTEK LLC will cancel the order and refund your purchase price in full. Any bank fees or credit card fees or foreign conversions or conversion fees are between you the customer and your bank or credit card company and not the responsibility of MiningTEK LLC. Please contact your bank or credit card company to understand these charges or fees and in the event of a refund MiningTEK LLC is not responsible to reimburse any bank fee or credit card fee and/or foreign conversion costs/fees under any circumstances. These terms apply to ALL consumer purchases of MiningTEK products, Affiliate products, software, services, and/or support.
This is a Binding Agreement:
As an Agreement between MiningTEK LLC and yourself, it may NOT be altered, supplemented or amended by any other document unless the new document is signed by both you and MiningTEK LLC. In addition to this document, the terms contained within the other MiningTEK LLC documents referenced in this Agreement, including MiningTEK LLC's Return Policy.
Orders, Pricing and Payments:
MiningTEK LLC strives to communicate accurate pricing and product information but will not be held responsible for any pricing, typographical, or other errors in such communications. Your order is subject to cancellation by MiningTEK, in MiningTEK's sole discretion. Unless otherwise agreed to by MiningTEK LLC, payment must be received by MiningTEK LLC prior to our acceptance of an order. MiningTEK LLC may process payment for and ship parts of an order separately. MiningTEK LLC is not responsible for any import taxes, customs duties or import duties on international orders.
Warranties:
MiningTEK LLC rigs covered by the individual component manufacturer warranty only. MiningTEK LLC MAKES NO OTHER WARRANTIES FOR MingingTEK-BRANDED PRODUCT, AND MAKES NO WARRANTIES WHATSOEVER FOR SERVICE, SOFTWARE, MAINTENANCE OR SUPPORT OR FOR NON-MiningTEK BRANDED PRODUCT. SUCH PRODUCT, SOFTWARE, SERVICE, MAINTENANCE OR SUPPORT IS PROVIDED BY MiningTEK LLC "AS IS" AND ANY THIRD-PARTY WARRANTIES, PRODUCTS, SOFTWARE, SERVICES, MAINTENANCE OR SUPPORT ARE PROVIDED BY THE ORIGINAL MANUFACTURER OR SUPPLIER, NOT BY MiningTEK LLC. SOME STATES DO NOT ALLOW LIMITATIONS OF IMPLIED WARRANTIES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
Receiving Warranty or Service Support:
IT IS YOUR RESPONSIBILITY TO BACK UP ALL EXISTING DATA, SOFTWARE AND PROGRAMS BEFORE RECEIVING SERVICES OR SUPPORT (INCLUDING TELEPHONE SUPPORT). MiningTEK LLC AND/OR YOUR THIRD-PARTY SERVICE PROVIDER WILL HAVE NO LIABILITY FOR LOSS OR RECOVERY OF DATA OR PROGRAMS, OR FOR LOSS OF USE OF SYSTEM(S) ARISING OUT OF THE SERVICES OR SUPPORT OR ANY ACT OR OMISSION, INCLUDING NEGLIGENCE, BY MiningTEK LLC OR YOUR-THIRD-PARTY SERVICE PROVIDER. Parts used in repairing or servicing Product(s) may be new, equivalent-to-new, or reconditioned.
Limitation of Liability:
MiningTEK LLC DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR PRODUCT NOT BEING AVAILABLE FOR USE, LOST PROFITS, LOSS OF BUSINESS OR FOR LOST OR CORRUPTED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES AND SUPPORT. EXCEPT AS EXPRESSLY PROVIDED HEREIN, MiningTEK WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, MiningTEK IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT INVOICED FOR THE APPLICABLE PRODUCT. SOME JURISDICTIONS MAY NOT ENFORCE ALL OF THESE LIMITATIONS, AND ONLY THE LIMITATIONS THAT ARE LAWFULLY APPLIED TO YOU IN YOUR JURISDICTION WILL APPLY.
Purchases may not be resold or exported:
Your purchase is for your own use, not for resale or export. Your purchase may not be sold, leased, or transferred to restricted countries, restricted end users, or for restricted end uses according to U.S. export and sanctions laws.
Governing Law:
THE PARTIES AGREE THAT THIS AGREEMENT, ANY SALES THERE-UNDER, OR ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE) BETWEEN YOU AND MiningTEK LLC arising from or relating to this Agreement, its interpretation or the breach, termination or validity thereof, the relationships which result from this agreement, MiningTEK's advertising, or any related purchase SHALL BE GOVERNED BY THE LAWS OF THE STATE OF Michigan, WITHOUT REGARD TO CONFLICTS OF LAW.
Dispute Resolution and Binding Arbitration:
YOU AND MiningTEK LLC and subsidiaries ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.
ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN CUSTOMER AND MiningTEK LLC and subsidiaries, its agents, employees, successors, assigns, direct and indirect subsidiaries, and any third party providing any products or services to you in connection with your purchase (collectively "MiningTEK LLC") arising from or relating in any way to your purchase of Product, this Agreement, its interpretation or the breach, termination or validity thereof, the relationships which result from this Agreement (including relationships with third parties who are not signatories to this Agreement), MiningTEK LLC's advertising or any related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION. The arbitrator shall have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision including any unconscionability challenge or any other challenge that the arbitration provision or the Agreement is void, voidable or otherwise invalid. The arbitration shall be administered by the American Arbitration Association (AAA) or JAMS (or a substitute forum if both are unavailable). Arbitration proceedings shall be governed by this provision and the applicable procedures of the selected arbitration administrator, including any applicable procedures for consumer-related disputes, in effect at the time the claim is filed. Consumer claimants (individuals whose transaction is intended for personal, family or household use) may elect to pursue their claims in small-claims court rather than arbitration. The arbitration or small-claims court proceeding will be limited solely to the customer's individual dispute or controversy.
You agree to an arbitration on an individual basis. In any dispute, NEITHER CUSTOMER NOR MiningTEK LLC SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS, OR ARBITRATE OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. If any provision of this arbitration agreement is found unenforceable, the unenforceable provision shall be severed and the remaining arbitration terms shall be enforced (but in no case shall there be a class arbitration.
Modifications for Terms and Conditions:
MiningTEK LLC may make changes to the Site and the Terms and Conditions. It is your responsibility to review the Terms and Conditions for updates or changes. If you do not agree with the Terms and Conditions, you should not use MiningTEK LLC's website.
